My "department" runs on a 5x2 schedule, basically with no chart. Every calendar week is a new week for the schedule.

How this 5x2 "hybrid" schedule works is that as long as you get 2 days off, every 7 days (Sunday to Saturday) you're good. Doesn't sound too bad until the supervisors get a hold of your days off and start switching them. So week 1 you may have Monday-Tuesday off but week 2 you might have a Thursday-Friday off. Now this doesn't happen often, just days where various training classes are being attended and of course to prevent paying OT when vacation and personal days are taken.

Does this warrent overtime? Some guys work 6, 7, 8 straight days WITHOUT getting overtime.

Any cases discussing this or published reports about other departments doing anything like this?

Most likely it will depend on the wording in your contract. Most contracts read that any work performed beyond the hours of your scheduled shift are subject to overtime. Additionally, any work performed beyond 40 hours (or however many hours you work in a 7 day period) in week are subject to overtime.

We also work 5 on 2 off our contract clearly says any hours over your 8 hour shift daily will be compensated with OT pay.

Where Iam at we work a 5x2 8 hr tour. However until we hire it has been more like 5x2 12 hr tour.
